Rental Terms & Conditions 

Guest must be 21 years or older to make a reservation, check in and receive door codes. ID will be required. 

ALL LOCATIONS HAVE A 4:00PM CHECK-IN/10:00AM CHECK-OUT 

RENTAL PAYMENTS/DEPOSITS 

Reservations will be considered confirmed upon receipt of the 50% Reservation Deposit along with review and acceptance of these Terms & Conditions.  A valid Credit Card number on file is required on all reservations.   

The total cost of the reservation including rent, fees, and taxes, shall be paid based upon the following structure: 

  • If your arrival is within 60 days, payment is required in full. Payment is required in full no less than 60 days prior to arrival date to secure your rental. 
  • If your arrival is 61+ days away, 50% deposit is due at the time of booking with the remaining 50% due no less than 60 days prior to arrival date. 

CONFIRMATION/CANCELLATION

  • Cancellations made 60 days or more before arrival date will get a full refund minus a 10% cancellation fee.  
  • Cancellations made 30 days or more but less than 60 days from arrival will receive 50% of the total amount paid.  
  • Cancellations made with less than 30-day notice forfeit 100% of the reservation fees 
  • No shows or cancellations less than 24 hours prior to arrival will result in 100% forfeiture of the total rental amount.  No refunds for early departure. 

Security Deposits: As a condition to the rental of all vacation properties, Compass Properties reserves the right to charge the guest’s credit card for any and all uncovered guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy.  This includes any expenses relating to intentional or reckless damage, cleaning of the unit beyond a normal rental cleaning or for any theft of property from the unit, to the credit card on file. The security deposit is $250. This is a ‘hold’ on the card on file and will not be processed unless damage occurs.  

ARRIVAL TIME

Check-in begins at 4:00pm.  We do our best to have your accommodations available by this time. Guests are not permitted on the premises before the property is ready for occupancy. If you are in the area prior to check-in time, please enjoy the area’s many attractions and restaurants. 

UPON ARRIVAL 

In the event of a problem getting in the vacation rental or if there are problems with condition or functionality of the vacation rental, please immediately contact the office or answering service after hours at (865) 315-1463. If it is after office hours and the issue is an emergency we will return your call as soon as possible.   

DEPARTURE TIME

Check-out time is 10:00am.  Late check-outs are not permitted. Late departures will result in the booking party being charged $100 per every half-hour.  
 
In order to help us keep the property functioning appropriately for all guests, we ask that you please adhere to the following check-out guidelines: 
 
•    Do NOT strip the bed linens. 
•    Place used towels and washcloths in the nearest bathtub or shower.  
•    Turn off all lights and small appliances and set the heat to 65 degrees in the winter and AC to 75 degrees in the summer. 
•    Please log out of all personal accounts – Netflix, Disney, Amazon Prime, etc.

•    Start dishwasher (if applicable)  
•    Please make sure all garbage is placed outside in the exterior containers or taken to community trash receptacles and the container is fully closed and latched.  
•    Be sure all doors and windows are locked upon your departure.  
 

Any personal items left behind or lost during a stay are the responsibility of the guest. We are not responsible for items left behind or lost. However, we will ship back any items that are found (if the guest requests them) by a local shipping service. The shipping fee is charged to the guest’s credit card. We hold on to any items left behind for 30 days to see if they are claimed before disposal. 

NUMBER OF GUESTS/GROUP RESTRICTIONS 

The total number of people occupying a unit at any one time MUST NOT EXCEED the maximum occupancy listed below.  No exceptions.  If an excessive number of people are found in your unit, you will be asked to leave and no refunds will be given. 
 
Our properties cannot be used for parties, weddings or large family reunions due to City Ordinance and Fire Code.  We will also not tolerate complaints of loud noise and underage drinking.  Any of these situations will result in eviction without any refunds being issued. 

Absolutely no house parties or unsupervised large student groups are allowed. We reserve the right to refuse service to anyone, at our discretion. Minors must be accompanied by a parent or legal guardian. If a party is discovered to be taking place in any of our units, the entire group will be required to leave. No refunds will be given. Gatherings associated with birthdays, anniversaries, graduations are acceptable as long as the maximum occupancy of the unit is not violated and the quiet hours are respected.  

LINENS, TOWELS, AND SUPPLIES

Towels, sheets, pillows and blankets are not meant for outside use.  Please bring your own beach towels for hot tub use. Guests are responsible for maintaining the condition of all linens.  An initial ‘starter’ supply of trash liners, paper towels, toilet paper and soap is provided.   

SMOKING

All of our properties are NON-SMOKING and NON-VAPING units. Guests who violate this rule will be assessed an additional non-refundable deodorizing and cleaning fee up to $500.00 and may also be subject to immediate eviction  

DAMAGES OR EXCESSIVE CLEANING 

If there is a need for any extra or excessive cleaning upon your departure, you will be charged a minimum of $75.00 depending on the cleanliness issue. 
 
•    Any theft, vandalism or damage will be photographed and reported to the police and may be followed by litigation. 
•    Any guest that we are forced to evict will forfeit all monies paid and no credits will be issued. 
•    Please remember that when you rent with us, this rental agreement is considered a legal and binding contract and therefore gives Compass Vacation Properties the right to collect payment for damages, missing items, and excessive cleaning that are made necessary by your stay. 

PLUMBING

Do not put any paper towels, napkins, baby wipes, or feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain. 

PET POLICY

We love pets! However, unless specifically approved in writing, pets, as well as animals of any kind, are not allowed, with the exception of recognized and approved service animals. Properties that allow pets are limited to two (2) animals of no more than seventy five (75) pounds each. Pet-friendly reservations will be subject to a non-refundable pet fee per approved animal. Pets are not allowed in pools, hot tubs, bathtubs, or showers. 

The pet fee covers entry to the property and does NOT cover any of the following: 

  • Urine on floors, carpet, linens, furniture, etc. 
  • Scratched floors, walls, doors, trim, furniture, etc. 
  • Damage to carpet, rugs, blinds or any other items in the property 
  • Excessive pet hair 
  • Extra cleaning and flea treatments 

In the event a guest allows an unapproved or non-allowed animal of any kind on the Premises, Guest will be assessed an additional non-refundable fee of $500.00 and may also be subject to immediate eviction. Please discuss this issue with us if you have any questions.  

SUBSTITUTION OF ACCOMODATIONS

If this property becomes unavailable prior to your arrival, from circumstances beyond our control (such as property sold to another owner, unforeseen construction, etc.), we will make every attempt to move you to a comparable property.  If a comparable property is unavailable, you will have the option of either selecting from our other available properties (an increase in rental fee may apply) or a refund of your total rents paid.  We will make every attempt to notify you as soon as possible if a substitution must be made. 

FREE INTERNET SERVICES/TELEVISION 

Most properties have complimentary internet services available.  These services are contracted with and provided by a third party therefore, we do not have control of the quality or availability of this service.  The service is not guaranteed and will not warrant discounts or emergency services.   

Since each property is individually owned, the cable or satellite provided can also vary, depending on what package level the owner has provided. 

FURNISHINGS

Each rental property is privately owned and furnished according to the owner’s individual style. Basic equipment and furnishings for a comfortable vacation are provided.  Please note that all of our units are individually owned real estate and thus are individually decorated. All of the properties come with fully equipped kitchens. This includes basic cooking and eating utensils, as well as drinkware. All of the properties have coffee makers, but we do not supply filters or coffee. Not all properties are equipped with dishwashers. Please make sure you check your unit’s amenity list, to see if it is provided. Also, not all properties have washers and dryers. For those units that do provide a washer and dryer, we may not provide laundry detergent or fabric softener. We do provide all of our guests a starter supply of dish soap, dishwasher soap (if applicable), hand soap, body soap, toilet paper, and trash bags. Any additional items needed will need to be brought with you or purchased from a local store. 

Optional items that may be provided at your property could include blenders, crock pots, blow dryers, irons, and ironing boards.  If you think you might need them during your stay, please check your unit’s amenity list or ask us.  
 
Some properties are on wells. Although well water is typically safe for human consumption, bathing, etc., if you have concerns about well water we suggest that you buy drinking water or bring a filter (Brita) for your consumption during your stay with us. Feel free to ask us if your rental is on a well. 
 
Moving furniture is prohibited. Do not move arcade games, pool tables, or appliances for any reason. Pool tables are balanced and leveled. You will be responsible for all damage and costs resulting from correcting a pool table that has been moved. 

HOT TUBS AND COVERS

Our hot tubs are drained, cleaned and chemically treated after each guest. Please allow several hours for the water to reach its optimum temperature. Leave the cover on when the unit is not in use to keep the hot tub clean and the temperature optimized. All guests should rinse off prior to entering the hot tub and after each use. The booking guest will be responsible for sharing potential hot tub hazards with their group. Hot tub use is strictly at your own risk. Children under the age of 10, Pregnant women and persons with heart conditions should not use the hot tubs. Guests with cuts or external infections should not use the hot tub. Do not have any glassware around the hot tub, and do not consume food or alcohol while sitting in the hot tub.  

HOT TUB DAMAGES

Hot tubs are fully inspected after each rental. Soaps, bubble baths, and oils are PROHIBITED in the Hot Tubs. There will be a minimum charge of $50.00 if any are found after your departure. This is due to excessive cleaning and/or possible damage to the hot tub. Damage done to any pump or motor from soaps, bubble bath or oils will not be labeled as “accidental” and is not covered under the Damage Protection. Damage done to any cover will result in a $400.00 fee for replacement and will be charged to you if damages are discovered after you have checked out. 
 
By using the hot tub, and by accepting this reservation, you are absolving Compass Vacation Properties and the owner of any and all responsibility related to the hot tub or its use. 

FIREPLACES 

All indoor fireplaces are closed from April 1st through October 1st. Do NOT Burn anything in the gas fireplaces. You will be responsible for any damage. Many of our properties have gas logs with timers installed. If you have questions on fireplace use, please let us know. Please do not rearrange or move the logs in the gas fireplaces. You will be charged for damages caused. Firewood for wood-burning fireplaces and/or firepits is not provided, but is available at most gas stations or grocery stores in the area. 

RIGHT OF ENTRY 

Guest(s) agree that Compass Vacation Properties reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate. 

TRAVEL INSURANCE 

This is an optional insurance that is offered to our guests.  The insurance offers coverage for such items as loss of job, death of a family member, medical emergencies, deployment, severe weather incidents, and more. Pre-existing conditions are covered in addition to unforeseen illness.  We strongly recommend purchasing this insurance during the winter months. This insurance has to be purchased at specific intervals after your deposit is made depending on the policy. If you have any questions on what is covered, please contact a Travel Consultant.
 

Maintenance and After-Hours Emergency Calls

It is expected that items on the Premises including, but not limited to: air conditioning, washer, dryer, refrigerator, hot tub, etc., as well as utility services such as electric, water, cable/satellite TV, internet, and natural gas could potentially break or be disrupted from time to time. Compass Properties will attempt, during normal business hours, to repair the problem as soon as possible. Owner assumes no liability to Guest if such should occur, as all products have a useful life and break down occasionally. Our normal office hours are 7 a.m. – 6 p.m, 7 days per week. For after hours assistance, call our office at 1-865-315-1463. There are NO refunds for early departures. For life-threatening emergencies, call 911.  
 
Power Outages: The cabins in mountain areas sometimes experience power outages. If you are staying in a cabin or chalet in the Smoky Mountains when the power goes out, please call our office or Sevier County Electric Co. at 865-453-2887 and they can identify the issue. If your unit has well water, you will not have water during the power outage. It is suggested to have an extra gallon or a case of water on-hand in inclement weather situations. Compass Vacation Properties is not responsible for power outages and does not refund or compensate for power outages or other acts of nature. 
 
Inclement Weather: Please be aware of the possible weather and road conditions you may encounter, depending on the time of year you are traveling. Chains and/or 4-wheel drive vehicles may be required for a few of our properties due to weather conditions. When preparing for a stay during winter months, it is advised to bring flashlights and warm clothes. Mountain weather can be unpredictable late-November through mid-March. Compass Vacation Properties does not offer any refunds if you are not able to make it to your property due to the weather and/or road conditions. During these months, we strongly recommend that you purchase trip insurance.  

Construction: While we do our best to make guests aware of any nearby development areas, we cannot always predict construction plans in the area. There is a possibility that construction projects may be in progress near any rental property during the time of your stay. Therefore, we have no control in these situations and no compensation or substitutions to other properties will be considered. 

SAFETY & SECURITY RISKS

Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Compass Vacation Properties does not assume any responsibility for injuries resulting from failure to use due caution. Children must be supervised at all times. Any type of open flame, including candles, are not allowed inside Compass properties. 

Eviction

Guests and their guests agree to adhere to local laws, rules, and regulations, to not disturb the peace, to keep the property in a clean and sanitary condition, and to comply with the no-smoking and no-pets rules. Guests are subject to immediate non-judicial eviction from the rental for the following reasons: (1) Smoking anywhere inside Premises or on decks or patios attached to Premises; (2) Pets on the rental property, unless allowed with paid pet fee; (3) Violation of the illegal drug or activity provision; (4) Complaints of noise, loud music, foul language, or otherwise disturbing of the peace; (5) Violation of any fire safety policy; (6) Destruction and/or damage of the Premises; (7) Failing to vacate the Premises by the aforementioned checkout date and time; or (8) For any reason the Owner or their Agent deems appropriate in order to maintain the safety and security of the Premises and surrounding areas. The entire amount of rent and security/damage deposit will be forfeited for violation of any of the foregoing reasons, regardless of whether Guest is evicted. 

Escrowed Funds Release

Pursuant to the Tennessee Code Annotated, Title 47, Chapter 18 and Title 62, Chapter 13, Section 62-13-104(b)(3), Subdivision (D)(i), Compass Vacation Properties discloses the following policy: 

“All advance rent deposits, damage fees, taxes, and balance of rent due are deposited into a bank rental operating account. These deposits are considered earned income to Compass Vacation Properties upon receipt and may be used immediately. Any refunds are disbursed from the general fund of Compass Vacation Properties and are on a case-by-case basis.” 

INDEMNIFICATION AND HOLD HARMLESS

While Compass Vacation Properties and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Compass Vacation Properties and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and grills) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Compass Vacation Properties and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees, their heirs, assigns and successors in interest for good and valuable consideration, hereby agree to forever release and hold-harmless and indemnify Compass Vacation Properties, the legal Owner, their heirs, assigns, successors and the Condominium Association or Homeowner’s Association (if applicable) in interest, from any and all liability for claims, actions, causes of action, damages, injuries or legal fees relating in anyway whatsoever to the use by the above referenced tenants and their guests located on the premises stated in this agreement. 

Arbitration

Guest agrees to settle any disputes and/or legal complaints arising under or related to this contractual agreement, through the process of arbitration. Guest agrees to waive the right to sue, participate in class-action lawsuits, and appeal. Furthermore, Guest agrees to pay all costs, expenses and attorney’s fees, as allowed by law, expended or incurred by Owner or Agent by reason of any default or breach by Guest of any of the terms of this Lease. 

Vacation Rental Damage Protection (G-20VRD): As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $5,000. Any damages that exceed $5,000 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of [Policy Limit]. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Plan documents here: www.csatravelprotection.com/certpolicy.do?product=g-20vrd. The Vacation Rental Damage can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance Insurance Services to pay directly Compass Properties, LLC any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Compass Properties directly if you do not wish to participate in this assignment.

Guest Protect Travel Insurance (G-330CSA)

 Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge, and 24/7/365 emergency assistance. We strongly recommend you purchase this valuable protection. Additional terms and conditions apply; please read your Plan documents carefully and contact Generali Global Assistance at 866-999-4018 with coverage questions. 

I have read and agree to abide by the rules as outlined on this agreement.  I am also declaring that I am at least 21 years of age.  By providing a credit card number I am agreeing to have the rental amount as listed on this reservation and/or any uncovered damages to the unit charged to my credit card.
